Jury system is broken

|

Need I say more than this? Jurors who question the legitimacy of unconstitutional or immoral laws are kicked off the jury. In short, we can all rest assured that juries--the last check and balance against government tyranny in the courts--will blindly obey the will of their government masters. How is this freedom?

Frankly, I'm shocked--shocked that such a freethinking juror made it past jury selection. I wonder how he did it. It's doesn't matter, of course, because such patriots (as opposed to slaves) will be duly punished.

Nullification

My favorite comment: "Cocaine is evil because it intoxicates the mind and breaks down inhibitions to immoral acts and is detrimental to a users health , while alcohol does none of this."

You can't really fault the judge for doing this. There are thousands of beaureaucrats and law enforcement officials who depend on the suppression of such perspectives for their livelihood.

It is surprising that someone who understood this much about law was not eliminated during voir dire.

Nullification indeed

Yes, jury nullification has effectively been nullified.

And I'm sorry to say, yes I can blame this judge. Self-interest is no good basis for a civilized society. If a judge is unable to see past his petty, singular job to the bigger picture, he has no business being a judge.

I suppose this just another result of our post-Christian culture: no longer do we serve the supreme Judge, but we serve ourselves alone.
